Summary of key changes

By the Resolution of the Government of the Russian Federation dated 18 September, the fees for the registration of intellectual rights and transactions therewith have been increased. In addition, the discount for electronic filing has been abolished and late payment will now incur a fee of double the amount. The changes will enter into force on 5 October 2024.

General information

Resolution of the Government of the Russian Federation No. 1287 dated 18 September 2024 (“Resolution”) amends Resolution of the Government of the Russian Federation No. 941 dated 10 December 2008 approving the regulation on patent and other fees for the registration of intellectual rights and transactions therewith.

Main changes

The Resolution introduces the following main changes:

  • The Resolution introduces new versions of Annexes No. 1 and No. 2 establishing the amount of fees for the registration of intellectual rights and transactions therewith. We have analysed the fees for the main categories and note an increase in all fees in the range of 10-15% (more details on the new fees can be found here).
  • The last paragraph of clause 7 of Resolution of the Government of the Russian Federation No. 941 dated 10 December 2008, which granted a 30% reduction in the amount of fees when applying in an electronic form to the authorised body for the performance of legally significant actions, is no longer valid. Therefore, the 30% discount for electronic filing has been abolished.
  • In some cases, in case of late payment, the fee used to be increased by 50% (in case of late payment of up to six months). In the Resolution, now double the amount of fees (increased by 100%) will immediately be applied in case of late payment, and the additional term for payment will be reduced to one month instead of six months.

The changes will enter into force on 5 October 2024 (the Resolution does not provide a special procedure for entry into force, therefore it will enter into force seven days after the date of its official publication on 27 September 2024).
